Terms of Service Addendum

Effective Date:  March 24, 2026

Service Covered:  KinStory™ Memorial Genealogy Service

These KinStory Service Terms (“KinStory Terms”) are incorporated into and made part of The Kinstructure Company LLC General Terms and Conditions. In the event of any conflict between these KinStory Terms and the General Terms and Conditions, these KinStory Terms shall control with respect to KinStory services.

Section KS-1. Scope of Services

KS-1.1 What KinStory Provides

KinStory, hereinafter referred to as (“Company”), provides targeted genealogical research and narrative documentation services to assist families in commemorating deceased individuals through obituaries, eulogies, memorial programs, and family archive materials. Company services include ancestral name and origin research, family connection documentation, cultural and regional heritage context, and narrative-style family history summaries when these are available.   

KS-1.2 What KinStory Does Not Provide

KinStory is a research and documentation service. Company does not provide:

  • Legal genealogy services, genetic testing, or DNA analysis 
  • Certified or court-admissible genealogical records
  • Probate, estate, or inheritance documentation
  • Medical history research
  • Any guarantee of record availability, completeness, or accuracy of third-party historical records

Company is not a member of the Board for Certification of Genealogists, or the International Commission for the Accreditation of Professional Genealogists

KS-1.3 Use of Information

Information provided through the KinStory intake form will be used solely for the purpose of conducting genealogical research and delivering the requested memorial package. Company will not sell, license, or share Client-provided information with third parties except as necessary to conduct research or as required by law.

Section KS-2. Research Scope, Limitations, and No-Guarantee Clause

KS-2.1 Research Limitations

Client acknowledges that the availability, accuracy, and completeness of genealogical records is subject to factors entirely outside Company’s control, including but not limited to: destruction or inaccessibility of historical records; records created in error or under variant spellings; restricted access to third-party archives or government records; records that exist but cannot be located within the agreed timeline; and conflicting or incomplete information across sources.

KS-2.2  Disclaimer No Guarantee of Outcome

Company commits to conducting thorough, good-faith research using available genealogical resources and presenting findings accurately within the agreed scope of service.  Company promises to use its “Best Efforts”.  COMPANY EXPRESSLY DOES NOT GUARANTEE ANY SPECIFIC RESEARCH OUTCOME, QUANTITY OF GENERATIONS DOCUMENTED, NUMBER OF FAMILY CONNECTIONS IDENTIFIED, OR LEVEL OF HISTORICAL DETAIL ACHIEVED. 

KS-2.3 Accuracy of Client-Provided Information

The quality, scope and speed of research is materially dependent upon the accuracy and completeness of information provided by Client on the KinStory Intake Form. Company shall not be liable for research limitations due to inaccurate, incomplete, or misleading information provided by Client.  

Section KS-3. Pricing, Deposits, and Payment Terms

KS-3.1 Service Tiers and Pricing

KinStory services are offered at the following rates, subject to change with notice as provided in the General Terms and Conditions:

KS-3.2 Deposit Requirement

A non-refundable deposit equal to fifty percent (50%) of the total service fee is required before research will commence. Submission of the intake form does not constitute a service agreement or obligate the Company to begin research. Research begins only upon: (a) receipt of the required deposit, and (b) written confirmation from Company that the request has been accepted.

KS-3.3 Balance Payment

The remaining balance is due upon delivery of the completed KinStory package.  Company reserves the right to withhold delivery of final materials until the remaining balance is paid in full. All results are considered Company Work Product until final payment is received and distribution to client is made.  

KS-3.4 Refund Policy

Deposits are non-refundable once research has commenced. If Company determines it is unable to fulfill the service after accepting the deposit but before research has commenced, a full refund of the deposit will be issued. No refunds will be issued after research has commenced, regardless of the volume of records located or the scope of findings.  If Client is not authorized, Client is considered in breach of this agreement and no refund will be issued.   

KS-3.5 Custom Pricing

Complex lineage research, multi-generational scope, or specialized requests may require custom pricing quoted in writing prior to deposit collection and agreed to in writing by Client before work begins.

Section KS-4. Turnaround Times and Delivery

KS-4.1 Estimated Timelines

Turnaround times are estimates based on typical research conditions and are not guaranteed delivery dates because Company relies on Client responses and input.  Business days exclude weekends and federal holidays.  Company will communicate with Client proactively if a timeline cannot be met.

KS-4.2 48-Hour Emergency Package Availability

The 48-Hour Emergency Package is subject to Company capacity at the time of request and is not available on a self-service basis. Client must contact Company directly at support@kinstructure.com prior to submitting a deposit to confirm availability. The 48-hour turnaround clock begins only upon: (a) written confirmation of availability by Company, (b) receipt of the required deposit, and (c) receipt of a substantially complete intake form.

KS-4.3 Delays Due to Client

If Client fails to provide requested information or documentation within a timeframe communicated by  Company, Company reserves the right to adjust the turnaround timeline accordingly.

KS-4.4 Force Majeure

Company shall not be liable for delivery delays resulting from circumstances beyond its reasonable control, including but not limited to, record repository closures, third-party system outages, weather outages, pandemic declaration, war or events as defined in the General Terms and Conditions.

Section KS-5. Client Data, Privacy, and Sensitive Information

KS-5.1 Nature of Information Collected

In the course of providing KinStory services, Company will collect personal information about both the Client and the deceased individual, including full legal names, dates of birth and death, geographic origins, family relationships, and cultural heritage information. Client represents he or she is authorized to provide such information on behalf of themselves and, where applicable, the deceased individual’s family. If not authorized, KS-3.4  controls.  

KS-5.2 Research Materials and Findings

Research findings and narrative materials produced in connection with a KinStory engagement are delivered to the Client for personal and memorial use.  Company retains no ongoing claim to Client-provided family information or its work product, following delivery to client and final payment.

KS-5.3 Anonymized Use for Business Development

Company reserves the right to reference KinStory engagements in general terms for marketing or portfolio purposes only with the express written consent of Client. No identifying information about the deceased or the Client’s family will be used without written consent.

Section KS-6. Intellectual Property and Deliverable Ownership

KS-6.1 Client Ownership of Deliverables

Upon receipt of final payment, Client owns the KinStory memorial package which is intended for personal, family, and memorial use.

KS-6.2 Company Methodology

Company retains all rights to its research methodology, workflows, templates, and proprietary processes, all considered work product.  The delivery of a KinStory package does not transfer rights to Client, the Company’s underlying research systems or processes from which work product is derived.

KS-6.3 Third-Party Records

Genealogical records sourced from third-party repositories are subject to the intellectual property rights of their respective owners. Company provides citations and references to source materials but cannot guarantee a Client’s independent right to reproduce those source records beyond what is permitted by the applicable repository’s terms of use.

Section KS-7. Funeral Home Referral Relationships

KS-7.1 Nature of Referral

KinStory services may be made available through referral relationships with licensed funeral homes (“Referring Partners”). A referral from a Referring Partner does not create any contractual obligation between the Client and the Referring Partner with respect to KinStory services. The Client’s service agreement is solely with The Kinstructure Company LLC.

KS-7.2 No Agency Relationship

Referring Partners are independent third parties. They are not agents, employees, or representatives of The Kinstructure Company LLC and have no authority to modify these Terms, make representations about service scope, or bind Company to any commitment.

Section KS-8. Client Consent and Acknowledgment

The following language is proposed for the intake form consent checkbox. Attorney review of this specific language is requested.

CONSENT:

By submitting this form, I confirm that:

(1) I am at least 18 years of age and authorized to request this service; 

(2) I have read and agree to The Kinstructure Company LLC Terms and Conditions and the KinStory Service Terms; 

(3) I understand that a 50% non-refundable deposit is required to begin research and the remaining balance is due upon delivery; 

(4) I understand that genealogical research outcomes cannot be guaranteed and are subject to the availability of historical records; and 

(5) I am authorized to provide the personal information submitted in this form on behalf of myself and, where applicable, the deceased individual’s family.

Section KS-9. Governing Law and Jurisdiction

The terms and conditions stated herein are in compliance with, 42 CFR 164.512; 42 CFR 164.502; 42 CFR Part 2; 16 CFR Part 453; USC 1306c; Texas Property Code Chapter 26; and Texas Government Code Section 552.1085.

These KinStory Terms of engagement shall be governed by the laws of the State of Texas.  Any legal disputes are restricted to Travis County as proper venue for litigation.  This is consistent with the General Terms and Conditions of The Kinstructure Company LLC.  All dispute resolution provisions of the General Terms and Conditions, including arbitration and class action waiver, apply to disputes arising under these terms.
